TERMS AND CONDITIONS

Group departure subject to a minimum of 10 passengers. If the necessary number of passengers is not reached, parties that made a reservation will be informed no later than 50 days prior to departure. At that time they can decide whether to pay the difference in cost and still travel, or cancel for a full refund.

General conditions:

These general conditions regulate the services contracted through Viajes Alear S.A. (from now on Alear).

Total acceptance of these general conditions, of each tour conditions y the ones pertaining to the transportation and/or service companies, will occur with partial or total payment of any of the trips at the time of making a reservation, and will be automatically incorporated to the contract without the need of a written a transcription in it.

Service requests and payments:

a)      The estimated price at the time of requesting services is subject to changes without prior notice, as a result of possible changes in the services and/or costs and/or exchange rate at the time of confirmation and transfer of monies.

b)      Special flights/charters or non regular flights: passengers should make full payment of the non regular transportation services or special flights at the time they are contracted, plus the corresponding land services reservations.

c)      Reservations are personal and non-transferable.

d)       Cruises, Spas, Ski Resorts and other services that have special contractual conditions, these conditions will be applied to the passenger.

PRICES INCLUDE: Transportation in accordance to itinerary specifications. Lodging at hotels indicated in each case or of similar classification, in rooms with private bathrooms and applicable taxes.

HOTELS CHECK IN AND CHECK OUT SCHEDULES: Check in is between 2:00 and 4:00 pm. Room should be vacated at 10:00 am, unless the hotel has a different policy.

PRICES DO NOT INCLUDE:

Visas, airport taxes, taxes to exit the country, sales tax, tickets to museums, national parks, local tourism taxes and in general, any personal expense such as communications, meals, tips and beverages, entry tickets to congresses, fairs and events.

Expenses for passenger’s voluntary extensions of services or for circumstances out of our control and in general, anything not specifically described in the corresponding itinerary, will be the passenger’s responsibility.

CANCELLATIONS:

a)      In case of disagreements that could affect services hired and confirmed by Alear, reimbursement of these will be subject to the terms and conditions under which the respective companies provide their services. In case reimbursements are granted, Alear will have the right to withhold as compensation a percentage of these in accordance with the cancellation policy of each service provider.

b)      Passengers that desist of contracted services – not included in c) bellow – regardless of the reason, will be subject to the applicable withholding on the total value of the contracted trip and that varies according to each service provider’s cancellation policy.

c)       Packages in non-regular flights / charters / special flights: If the passenger cancels or desists, regardless of the reason, the passenger will lose the total amount paid for non regular transportation or charter or special flight and only the portion of the price corresponding to land services (lodging, meals, tours), as determined by the Organizer in accordance with the service provider’s policy.

d)      Cancellations will only be valid when requested in writing. No verbal communication will be accepted for this purpose.

REIMBURSEMENTS AND CLAIMS

No amount whatsoever will be reimbursed for services not used by the passenger of his own will. When reimbursements apply, the will be processed – in all cases – through the selling agent at the end of the trip. No claims and/or reimbursement will be processed after 15 days following the end of services.

DOCUMENTATION

Documents and visas are strictly personal. It is the passenger’s exclusive responsibility to obtain all the documents and visas necessary, in good shape and valid. The organizer will not be responsible for inconveniences passengers could suffer for lack of proper documentation.

Should any passenger be unable to travel for the lack of documentation and visas, he/she will lose the services contracted in total, without any right to claim reimbursement.

ALTERATIONS

Alear reserves the right to alter any itinerary o change any of the hotels should it be necessary for causes of force majeure, without prior notice.

CONDUCT

Alear as the intermediary reserve the irrevocable and discretionary right of separating from the tour a passenger that because of this health status, conduct, behavior, etc. became a nuisance to the rest of the group or could spoil the tour. Passenger will have the right to reimbursement for the non utilized days of the tour, without any further compensation, and will be responsible for the cancellation expenses that could arise.

RESPONSIBILITIES

Alear (E.V.T Leg. 1491) explicitly declares that it is only an intermediary between the passengers and the entities or persons called upon to render services indicated in the itineraries, transportation companies, hotels, restaurants, etc. Accordingly, Alear declines any responsibility, including but not limited to, damages, injuries, accidents, delays or irregularities that could occur during the provision of services to the persons that travel though Alear, as well as luggage loss and other objects of their belongings, due to bad weather conditions, natural disasters, governmental decisions and other events that could occur outside of its control. When passengers travel on buses, in case of accidents, it is convenient to subject to the law of the country where the vehicle is registered. Transportation companies included in this program expressly declare that they are not responsible for any act, omission or accident, occurred to the passengers and belongings during the time that these are not on board of their airplanes and/or transportation means. The flight ticket will constitute the only contract between the Airline and the tour purchaser and/or passenger.

Airline Companies: Regular flights / charters and special flights are contracted from different commercial airlines, thus it should be taken into account that schedules, such as arrivals and departures, are tentative. These could be modified by said airline companies according to equipment availability and schedule frequencies for each particular circumstance. For all of the above, Alear does not assume any responsibility for the potential changes in schedules or any situations caused by others.

POLITICAL, SECURITY, SANITARY AND CLIMATOLOGICAL CONDITIONS IN THE COUNTRY OF DESTINATION

Alear will not be responsible for any and all damages, losses, delays, injuries, etc. caused by political, security, sanitary and/or climatological conditions and/or events. These will be the sole responsibility of the passenger, and he/she will have no claim against Alear.
